01 Owner and subject matter
The Call for Solutions website (the “Site”) is a project promoted and managed by Fondazione Tech Care, a participatory foundation with its registered office at Via Francesco Crispi 35, Pisa, Italy — email callforsolutions@roboticafestival.it (the “Foundation” or the “Owner”).
These Terms of Service (the “Terms”) govern access to and use of the Site and its services. If you do not agree, you must not use the Site.
02 Nature of the service
Call for Solutions is an intermediation and information service: it connects those who express a disability-related need (“proposers”), those who can develop technological solutions (“developers”) and those who can support them financially (“supporters”). The user acknowledges and expressly accepts that the Site:
- does not collect, hold or manage funds and is neither a crowdfunding platform nor a payment institution;
- does not develop, build or market the proposed solutions;
- does not guarantee that a proposal will be developed, funded, built or published, nor any result or financial return;
- merely facilitates contact between the parties, who conclude any agreements directly and exclusively between themselves, under their own responsibility. The Foundation is not a party to such agreements.
03 Submission of proposals and moderation
To submit a proposal you must provide a valid email address. The proposal is processed only after the user has confirmed their address through the link received by email.
Every proposal is subject to prior review and moderation. The Foundation may, at its sole discretion and without any obligation to give reasons, publish, not publish, request changes to, suspend, edit or remove any proposal or content at any time, even if already published.
04 Intellectual property and publication of ideas
This section is essential: please read it carefully.
- User's declarations. By submitting a proposal, the user declares and warrants that they are its author or hold all the rights needed to submit it and make it public, and that the content does not infringe any third-party rights (copyright, industrial property, confidentiality or image rights).
- Licence to the Foundation. By submitting a proposal, the user grants the Foundation a non-exclusive, royalty-free licence, with no limits of time or territory, to publish, display, reproduce, communicate to the public and share the proposal (texts, images, audio, video and attachments) on the Site and with potential developers, supporters and partners. The user remains the owner of the rights in their idea; the Foundation does not claim ownership of it.
- Public nature of proposals and absence of protection. The user acknowledges and expressly accepts that published proposals are publicly visible on the Internet and that, by their nature, ideas made public may be seen, copied, reproduced, used, resold, modified or re-proposed by third parties, on this or other sites, beyond the Foundation's control.
- No liability for copying by third parties. The Foundation and the Site offer no form of protection of intellectual or industrial property in the proposals and are in no way liable if the ideas, in whole or in part, are copied, misappropriated, reproduced, resold, exploited or re-proposed in modified form by third parties. The user expressly waives any claim or request for compensation against the Foundation on these grounds.
- Prior protection is the user's responsibility. If the user wishes to protect their idea (patent, design, trade mark or otherwise), they must do so before submitting it. By submitting the proposal without protection, the user assumes every risk connected with its public disclosure.
05 Disclaimer of warranties and limitation of liability
The Site and its services are provided “as is” and “as available”, without warranties of any kind. To the fullest extent permitted by law, the Foundation is not liable for:
- direct, indirect, incidental or consequential damage, or loss of opportunity, profits or data, arising from the use of or inability to use the Site;
- content, statements, conduct or breaches by users, proposers, developers, supporters or third parties;
- the outcome, quality, safety, feasibility or lawfulness of the proposals and solutions;
- agreements, negotiations, payments or disputes arising directly between the parties;
- interruptions, errors, malfunctions or unavailability of the Site.
06 Indemnity
The user undertakes to indemnify and hold harmless the Foundation, its bodies, collaborators and partners against any claim, damage, cost or expense (including legal fees) arising from a breach of these Terms, from the content submitted or from the infringement of third-party rights.
07 User obligations and conduct
The user undertakes to provide truthful information and not to submit content that is unlawful, defamatory, offensive, discriminatory, misleading or harmful to the rights of others, nor third parties' personal data without entitlement, nor sensitive data that are not strictly necessary. Any use of the Site for purposes other than those of the project is prohibited, as is the sending of spam or malicious software.
08 Personal data
Personal data are processed by the controller, Fondazione Tech Care, in compliance with Regulation (EU) 2016/679 (GDPR), as set out in the Privacy Policy, which forms an integral part of these Terms.
09 Email notifications
By using the service, the user agrees to receive service communications relating to their proposal (address confirmation, outcome of moderation, publication, expressions of interest and ratings received). These communications are an integral part of how the Site works.
10 Changes to the Terms
The Foundation may amend these Terms at any time. The updated version will be published on the Site with the relevant date. Continued use of the Site after the changes have been published constitutes acceptance of them.
11 Governing law and jurisdiction
These Terms are governed by Italian law. The Court of Pisa shall have exclusive jurisdiction over any dispute, without prejudice to the mandatory provisions of law protecting consumers.
